Cody Allen Eggemeyer was sentenced to a total of 95 years in prison in connection with a 2023 shooting by 135th District Court Judge Kemper Stephen Williams Nov. 7.
Williams sentenced Eggemeyer to 45 years in the Texas Department of Criminal Justice for Aggravated Assault with a Deadly Weapon; 25 years for Unlawful Possession of a Firearm by a Felon; and 25 years for Evading Arrest or Detention in a Motor Vehicle. All the sentences will run concurrently.
The DeWitt County jury in the trial that started Nov. 3 deliberated for only about an hour before returning guilty verdicts on all charges.
Eggemeyer was charged in connection with the shooting of James Lubyinskey on Oct. 15, 2023. The victim flagged down De-Witt County Sheriff deputies and identified Eggemeyer as the suspect who shot him during an argument.
Eggemeyer fled the scene before law enforcement officers arrived, and a warrant was issued for his arrest. Law enforcement officers attempted to stop a vehicle thought to be driven by Eggemeyer two days later, but he fled the scene again and a pursuit started.
Eggemeyer abandoned the vehicle in Westhoff and fled on foot in a wooded area and escaped despite the efforts of Nixon Police Department, Gonzales County Sheriff’s office, Department of Public Safety, U.S. Marshals, TDCJ K-9 search unit, Cuero Police Department, and Cuero EMS. With continuous work from the DeWitt County Sheriff’s Office, Eggemeyer was arrested on Oct. 18, 2023.
24th Judicial District Attorney Brian Cromeens thanked the jury, the judge and law enforcement for their work in sending Eggemeyer to prison. He noted that the judge appropriately considered the defendant’s prior criminal history in assessing the punishment.
